HeyBabe Terms of Use

Please read these Terms of Use ("Terms") carefully before using the HeyBabe: AI Girlfriend Chat GF application and website (collectively, the "Service"). These Terms constitute a legally binding agreement between you ("You," "Your," or "User") and Mary Gill ("Owner," "Company," "we," "us," or "our"), the owner and operator of the Service.
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you must discontinue use of the Service immediately.
IMPORTANT: THESE TERMS INCLUDE DISCLAIMERS OF WARRANTIES, LIMITATIONS OF LIABILITY, AND A WAIVER OF CLASS ACTION RIGHTS. PLEASE READ THEM CAREFULLY.
  • 1. DefinitionsApplication means the mobile software program named HeyBabe: AI Girlfriend Chat GF, available for download on iOS and Android devices.
  • Website means the website located at https://heybabeapp.com and its subdomains.
  • Application Store means the digital distribution service operated by Apple Inc. (Apple App Store) or Google Inc. (Google Play Store) from which the Application has been downloaded.
  • Content refers to all text, images, AI-generated messages, graphics, software, and other materials available through the Service.
  • Device means any device that can access the Service, such as a smartphone, tablet, or computer.
  • Subscription refers to paid access to the Service offered on a recurring basis.
  • In-app Purchase refers to any purchase of a product, item, service, or Subscription made through the Application.
  • AI Characters means all artificial intelligence-powered virtual personas available for interaction within the Service.
  • Country refers to the Republic of Poland.
2. Entertainment Purpose and Fictional Nature of Content2.1. The Service is an AI-powered entertainment platform. All characters, personas, dialogues, and interactions within the Service are entirely fictional and generated by artificial intelligence software. No real persons are depicted or represented by any AI Character in the Service.
2.2. All messages, responses, stories, and interactions produced by AI Characters are fictional content created solely for entertainment purposes. AI Characters do not possess consciousness, emotions, feelings, or real-world knowledge. Any resemblance to real persons, living or dead, is purely coincidental.
2.3. You acknowledge that you are communicating with software, not with a real human being. The AI Character responses are algorithmically generated and do not constitute personal advice of any kind.
2.4. The Service is NOT a provider of healthcare, medical, psychological, legal, financial, or any other professional services. The Service MAKES NO CLAIMS, REPRESENTATIONS, WARRANTIES, OR GUARANTEES that the content provides therapeutic, medical, or other professional help.
2.5. Do NOT use the Service in emergency situations. If you are experiencing a medical, psychological, or other emergency, please contact emergency services or a qualified professional immediately. We are not liable for any health-related consequences arising from use of the Service.
2.6. You should NOT rely on any information, advice, or suggestions provided by AI Characters for making real-life decisions. All AI-generated content is produced for entertainment only and may be inaccurate, incomplete, or misleading.
3. Eligibility3.1. You must be at least 18 years old (or the age of majority in your jurisdiction) to access and use the Service.
3.2. By using the Service, you represent and warrant that you meet the age requirement and have the legal capacity to enter into these Terms.
3.3. We do not knowingly permit individuals under 18 to use the Service. If we become aware that a user is under 18, we will terminate their account immediately.
4. Account Registration4.1. To access certain features of the Service, you may be required to create an account. You agree to provide accurate, current, and complete information during registration.
4.2. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4.3. You must notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage resulting from your failure to protect your account information.
4.4. You may have only one account with the Service.
5. Our Services5.1. HeyBabe provides an AI-powered chat service that enables you to interact with AI Characters using text messages. The AI Characters are software programs designed to generate conversational responses based on your input.
5.2. We reserve the right to modify, update, or discontinue any aspect of the Service at any time without prior notice.
5.3. We do not guarantee uninterrupted, error-free, or secure access to the Service.
6. Subscription and Payment Terms 6.1 SubscriptionThe Service or certain features may be available only with a paid Subscription. You will be billed in advance on a recurring basis (weekly, monthly, or annually) depending on the plan you select. Your Subscription will automatically renew under the same conditions unless you cancel it before the end of the current billing period.
6.2 Web-Based Payments (Stripe)For purchases made through the Website, payment processing is handled by Stripe, Inc. ("Stripe"). By making a purchase through the Website, you agree to Stripe's Terms of Service (https://stripe.com/legal) and Privacy Policy (https://stripe.com/privacy). We do not store your full credit card information. Stripe collects and processes your payment data in accordance with PCI DSS standards.
6.3 In-App PurchasesFor purchases made through the Application, billing is handled by the applicable Application Store (Apple App Store or Google Play Store) and is governed by that store's terms and conditions.
6.4 Subscription CancellationYou may cancel your Subscription at any time:
  • Web subscriptions (Stripe): By contacting us at admin@myaigirlfriend.fun or through your account settings on the Website. Your cancellation will take effect at the end of the current paid period.
  • App Store subscriptions: Through your device's subscription management settings (Apple App Store or Google Play Store).
You will not receive a refund for the current billing period upon cancellation, but you will retain access to paid features until the end of that period.
6.5 Fee ChangesWe may modify Subscription fees at any time at our sole discretion. Fee changes will take effect at the end of your current billing period. We will provide reasonable prior notice of any fee changes.
6.6 BillingYou must provide accurate and complete billing information. If automatic billing fails, we may issue an electronic invoice requiring manual payment within a specified deadline.
7. Refund Policy7.1. For subscriptions purchased through the Apple App Store or Google Play Store, refund policies of the respective store apply. We do not process refunds for in-app purchases directly — please contact the applicable store.
7.2. For web-based subscriptions (Stripe), refunds are governed by our Money-Back Policy, available at https://heybabeapp.com/money-back-policy.
7.3. Except as required by applicable law or as described in our Money-Back Policy, paid subscription fees are non-refundable.
7.4. You are not entitled to refunds for partial subscription periods.
8. Free Trial8.1. We may offer a free trial period at our sole discretion. You may be required to provide billing information to sign up for a free trial.
8.2. If you do not cancel before the free trial expires, you will be automatically charged the applicable Subscription fee.
8.3. We reserve the right to modify or cancel free trial offers at any time without notice.
9. License and Restrictions9.1. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes only.
9.2. You may NOT:
  • Copy, distribute, modify, or publicly display any part of the Service or its Content.
  • Reverse engineer, disassemble, decompile, or attempt to derive the source code of the Service.
  • Use automated systems (bots, scrapers, etc.) to access the Service.
  • Disrupt or interfere with the Service's servers or networks.
  • Bypass any security or access control measures of the Service.
  • Use the Service for any unlawful purpose.
  • Sublicense, sell, rent, or lease access to the Service to any third party.
10. User Content and Conduct10.1. You are solely responsible for all content you submit, post, or transmit through the Service, including messages sent to AI Characters.
10.2. You may NOT use the Service to transmit content that is:
  • Unlawful, threatening, abusive, harassing, defamatory, or obscene.
  • Infringing on intellectual property or privacy rights of any third party.
  • Spam, advertising, or unauthorized solicitation.
  • Containing viruses, malware, or other harmful code.
  • Promoting discrimination based on race, gender, religion, nationality, sexual orientation, or any other characteristic.
  • Impersonating any person or entity.
10.3. We reserve the right to remove any content and suspend or terminate accounts that violate these Terms, at our sole discretion and without prior notice.
10.4. Data Usage for AI Improvement. You acknowledge and agree that anonymized data from your interactions with AI Characters may be used to improve and train our AI models. This data will not include personally identifiable information.
11. Intellectual Property11.1. The Service and all its original Content, features, functionality, trademarks, and trade dress are and will remain the exclusive property of Mary Gill and her licensors.
11.2. The Service is protected by copyright, trademark, and other intellectual property laws of the Republic of Poland and international treaties.
11.3. You may not use our trademarks or trade dress without our prior written consent.
11.4. Any copyright infringement claims should be sent to admin@myaigirlfriend.fun with a detailed description of the alleged infringement.
12. Third-Party Links and Services12.1. The Service may contain links to third-party websites or services not owned or controlled by us.
12.2. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party services.
12.3. You acknowledge and agree that we shall not be liable for any damage or loss caused by or in connection with the use of any third-party services.
13. PrivacyYour personal information is governed by our Privacy Policy, available at https://heybabeapp.com/privacy. By using the Service, you consent to our data practices as described therein.
14. Disclaimer of WarrantiesTHE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT: (A) THE SERVICE WILL MEET YOUR REQUIREMENTS; (B) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) THE CONTENT WILL BE ACCURATE, RELIABLE, OR COMPLETE; OR (D) ANY DEFECTS IN THE SERVICE WILL BE CORRECTED.
ALL AI-GENERATED CONTENT IS PROVIDED FOR ENTERTAINMENT PURPOSES ONLY. WE MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING THE ACCURACY, SUITABILITY, OR RELIABILITY OF ANY CONTENT GENERATED BY AI CHARACTERS.
15. Limitation of LiabilityTO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY OR ITS AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY TO YOU FOR ANY CAUSE OF ACTION SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US FOR THE SERVICE DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS (USD $100), WHICHEVER IS GREATER.
16. IndemnificationYou agree to defend, indemnify, and hold harmless Mary Gill and her affiliates, officers, agents, and employees from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any content you submit through the Service.
17. Termination17.1. We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.
17.2. Upon termination, your right to use the Service ceases immediately.
17.3. You may request account termination by contacting us at admin@myaigirlfriend.fun.
18. Dispute Resolution18.1. Informal Negotiations. The parties agree to first attempt to resolve any dispute informally for at least thirty (30) days before initiating formal proceedings.
18.2. Governing Law. These Terms are governed by and construed in accordance with the laws of the Republic of Poland, without regard to its conflict of law provisions.
18.3. Jurisdiction. If you are a consumer residing in the European Union, you additionally possess the protection provided by mandatory provisions of the law of your country of residence. Both parties agree to submit to the non-exclusive jurisdiction of the courts of the Republic of Poland.
18.4. Class Action Waiver. To the fullest extent permitted by law, any dispute shall be resolved on an individual basis only. You waive any right to participate in class action lawsuits or class-wide arbitration.
19. Severability and Waiver19.1. If any provision of these Terms is held to be unenforceable or invalid, such provision will be modified to accomplish its objectives to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
19.2. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
20. Changes to These TermsWe reserve the right to modify or replace these Terms at any time. If a change is material, we will provide at least 30 days' notice before the new terms take effect. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.
21. Communication and NotificationsBy using the Service, you consent to receive occasional communications from us, including service updates, promotional offers, and important notices, via email, push notifications, or in-app messages. You may opt out of marketing communications at any time.
22. For European Union (EU) UsersIf you are a consumer in the European Union, you benefit from any mandatory provisions of the law of the country in which you reside.
